IMPORTANT NOTICE – PLEASE READ CAREFULLY. Please review these Terms of Service carefully, as they contain important information regarding your legal rights and obligations, including limitations of liability, warranty conditions, and dispute resolution provisions. By making a purchase on www.orfebre.com, you acknowledge and agree to be legally bound by these Terms.
To the extent permitted by applicable law in Puerto Rico and the United States, any dispute arising from your purchase will be subject to the resolution mechanisms established in this document and may limit available remedies.
EL ORFEBRE INC. is committed to manufacturing high-quality custom jewelry in accordance with the following terms, conditions, and policies.
1. WARRANTY COVERAGE
EL ORFEBRE INC. offers two distinct warranties, each covering a specific aspect of the product:
1A. Structural Manufacturing Warranty (30 Days)
The Structural Manufacturing Warranty covers exclusively manufacturing defects that compromise the structural integrity or functionality of the piece, such as defective soldering, loose settings due to mounting errors, or fractures originating during the production process.
This warranty is valid for thirty (30) calendar days from the delivery date and applies to all pieces manufactured by EL ORFEBRE INC., regardless of material.
Excluded from this warranty: normal wear, impact damage, misuse, external modifications, loss of shine, changes in finish or color, and any damage resulting from improper use.
1B. Gold Plating Maintenance Warranty (30 Days)
The Gold Plating Maintenance Warranty is an exclusive maintenance service for Sterling Silver 925 pieces with a gold-plated finish, covering the following services: polishing, deep cleaning, and gold plating renewal.
This warranty may be exercised once (1) within thirty (30) calendar days of delivery. For discounted pieces, the validity period is fifteen (15) days.
This warranty does not cover structural defects, which are covered exclusively by the Structural Manufacturing Warranty described in Section 1A.
2. WARRANTY EXCLUSIONS
The warranties described in Section 1 do not cover:
• Normal Wear: Natural wear, including loss of shine or color on gold-plated pieces.
• Improper Use: Damage caused by misuse, negligence, or contact with chemicals, liquids, corrosive substances, or extreme environments.
• Unauthorized Modifications: Alterations, modifications, or repairs performed by the customer or unauthorized third parties.
• Loss of Components: Parts or components damaged or lost after delivery.
• Impact or Accident Damage: Scratches, dents, bending of metal, or any physical damage caused after delivery.
3. WARRANTY CLAIM PROCEDURE
The customer must inspect the piece immediately upon receipt.
Any visible manufacturing defect must be reported in writing within two (2) calendar days of delivery. After this period, the piece will be presumed to have been received in optimal condition and in conformity.
To request evaluation under warranty, the customer must:
• Submit written notification within the corresponding period.
• Provide clear photographic evidence.
• Include a detailed description of the issue.
EL ORFEBRE INC., at its sole discretion, may:
• Repair the defective piece; or
• Issue a store credit for future purchases, if applicable.
EL ORFEBRE INC. reserves the right to technically evaluate each claim before determining whether warranty coverage applies.
4. LIABILITY LIMITATIONS
• EL ORFEBRE INC. shall not be liable for damages resulting from improper use, negligence, or accidents after delivery.
• Additional costs incurred by the customer without prior written authorization — such as shipping, labor, or adjustments — will not be covered.
• If the piece is modified, altered, or repaired by another jeweler or establishment outside of EL ORFEBRE INC., the warranty will be automatically voided. EL ORFEBRE INC. will not be responsible for costs incurred or damages caused during such external repairs.
5. CARE RECOMMENDATIONS
To extend the life of your jewelry, we recommend:
• Store the product in the packaging or case provided.
• Avoid contact with chemicals, perfumes, and excessive humidity.
• Perform periodic maintenance to preserve shine and color.
6. ALLERGIES, SKIN SENSITIVITIES & PERSONAL LIABILITY RELEASE
6.1. Allergies or Skin Sensitivities
EL ORFEBRE INC. is not responsible for allergic reactions or skin sensitivities caused by the use of jewelry made in Sterling Silver 925, 10K Gold, 14K Gold, or any other material used in our products.
Although we work with high-quality, nickel-free metals in most cases, each individual may react differently to certain metals or alloys. Customers with a history of allergies or sensitive skin are advised to consult a healthcare professional before purchasing jewelry.
By confirming your purchase, the customer acknowledges that the use of our jewelry in relation to their health, skin, or medical condition is at their own discretion and risk.
6.2. Safety of Use & Liability Release for Ingestion, Inhalation, or Misuse
The customer acknowledges and agrees that jewelry pieces produced by EL ORFEBRE INC. are designed exclusively as personal adornments for normal adult use.
They are not designed to be:
• Handled by children
• Ingested or placed in the mouth
• Inhaled
• Used as toys, teethers, or crib pendants
• Used for any purpose other than their original intended use
EL ORFEBRE INC. shall not be liable for personal injury, bodily harm, choking, accidental ingestion, inhalation, allergic reactions, accidents resulting from misuse, or use by unsupervised children. By completing the purchase, the customer expressly accepts that the use of the pieces is at their own risk and releases EL ORFEBRE INC., its officers, employees, and collaborators from all liability, to the maximum extent permitted by law.
6.3. Customer Commitment
The customer agrees to:
• Keep pieces out of reach of young children.
• Not allow minors to handle pieces without supervision.
• Not use jewelry as toys or objects for manipulation.
• Follow the care and maintenance instructions provided by EL ORFEBRE INC.
7. USE OF PRODUCT IMAGES AND CONTENT
EL ORFEBRE INC. reserves the right to photograph and/or record videos of fabricated pieces as part of its professional portfolio. These images may be used for promotional purposes on social media, the official website, and other digital media of the brand.
By making a purchase or requesting a custom design, the customer agrees to this condition by default. No personal information will be shared, and the customer will not be identified without their explicit consent.
Opt-Out Right: If the customer prefers that images of their piece not be used for promotional purposes, they must expressly notify EL ORFEBRE INC. in writing at servicio@orfebre.com at the time of order confirmation or before production begins. Opt-out requests received after images have already been published do not obligate EL ORFEBRE INC. to remove already-distributed content, but will prevent future use.
EL ORFEBRE INC. will not condition the provision of its services on the customer's consent to image usage.
8. DESIGN CLARIFICATION & FINAL RESULT
All our pieces are handcrafted and made to order. Images, renders, or sketches provided are approximate visual references.
• The customer accepts that the final product may present minimal differences in shape, proportion, shine, or color compared to the digital design or sketches.
• These variations do not constitute a defect or grounds for a claim.
• By approving the design or making payment, the customer confirms their agreement with this condition.
9. CUSTOMER RESPONSIBILITY FOR RING SIZE SELECTION
The correct size selection is the exclusive responsibility of the customer. EL ORFEBRE INC. is not responsible for inconveniences, discomfort, finger damage, circulation issues, or any problem related to an incorrectly selected size at the time of ordering.
The customer acknowledges and agrees that:
• The size provided at the time of ordering was supplied by the customer under their own judgment.
• EL ORFEBRE INC. manufactures the ring exactly in the requested size, without interpreting, adjusting, or recommending sizes unless explicitly requested by the customer.
• If the ring does not fit properly because the customer provided an incorrect size, this will not be considered a manufacturing defect and will not be covered under warranty.
• EL ORFEBRE INC. is not responsible for damages caused by a ring that is too small (e.g., pressure, swelling, irritation, or difficulty removing the ring).
• EL ORFEBRE INC. is also not responsible for issues resulting from a size that is too large (e.g., accidental loss of the ring).
• Any size adjustment, modification, or new fabrication due to an incorrect size will incur additional charges, which must be covered by the customer.
By confirming the order, the customer accepts that the requested size is final and that use of the product is at their own judgment and responsibility.
10. GOLD-PLATED JEWELRY
EL ORFEBRE INC. offers personalized jewelry in Sterling Silver 925 with gold plating, whose durability cannot be guaranteed due to use and external conditions.
10.1. Gold Plating Maintenance Warranty
We offer a thirty (30) day maintenance warranty from the delivery date, covering the following services once (1) within that period: polishing, cleaning, and gold plating renewal.
For products purchased with discounts, the gold plating warranty is valid for fifteen (15) days from the date of delivery.
10.2. What May Void the Warranty
The warranty will be voided if the piece shows evident physical damage such as:
• Dents
• Deep scratches
• Bent metal
• Alterations or similar damage
In these cases, additional repair charges may apply, or the warranty may be canceled per EL ORFEBRE INC.'s evaluation.
10.3. Official Purchase Requirement – Warranty Validity
For this warranty to be valid, all purchases must be made exclusively through our official website or any portal expressly authorized in writing by EL ORFEBRE INC., generating a valid and verifiable purchase order.
If the customer refuses or declines to make the purchase through official channels, or acquires the piece without a registered purchase order in the system, this warranty will be automatically voided. In such cases, EL ORFEBRE INC. will not accept claims for damage, maintenance, defects, or any other type of claim related to the piece.
10.4. Non-Transferable Warranty
The warranty is linked exclusively to the original buyer whose name appears on the purchase order. It is not transferable under any circumstance.
If the piece is resold, gifted, or transferred to another person, the warranty is automatically voided, even if still within the established period. Only the original buyer may request services under this warranty.
10.5. How to Activate Your Warranty
The piece must be in good condition of use and meet the requirements mentioned above. The customer must cover round-trip shipping costs. EL ORFEBRE INC. is not responsible for packages lost during the shipping process.
11. NON-RESALE CONDITION & LIABILITY LIMITATION
EL ORFEBRE INC. products are intended exclusively for personal use by the original buyer. The purchase of our pieces for resale, redistribution, or commercialization without prior written authorization from EL ORFEBRE INC. is strictly prohibited.
Any piece acquired with the intent to resell — or subsequently resold to third parties — is automatically excluded from any warranty, maintenance, repair, service, claim, or coverage offered by EL ORFEBRE INC.
EL ORFEBRE INC. shall not be responsible under any circumstance for physical damage, gold plating wear, defects from use or misuse, alterations by third parties, maintenance services, or issues arising from the reseller's handling, storage, or commercial practices.
Any attempt to use our products for resale purposes without authorization may result in the cancellation of future purchases.
12. CUSTOM ORDERS: CANCELLATION, CHANGES & REFUND POLICY
Custom orders placed with EL ORFEBRE INC. are considered special works manufactured exclusively for the customer. For this reason:
• Cancellations are not accepted once payment has been processed.
• No refunds, returns, or exchanges are made on custom orders.
• Any design modification requests — including letters, style, measurements, or specifications — must be made before design approval.
• Changes requested after design approval or during the fabrication process will incur additional charges.
• If the piece has already been cast, melted, or worked in metal, any modification will require new fabrication and the customer must cover the full cost again.
13. CHANGES & ADJUSTMENTS AFTER DESIGN APPROVAL
Once the customer approves a design, render, sketch, or visual proposal, that approval is considered final. EL ORFEBRE INC. is not responsible for:
• Changes of opinion by the customer.
• Corrections to names, letters, dates, or details supplied incorrectly.
• Redesign requests after fabrication has begun.
Any change requested after approval will incur additional charges, including adjustments, new pieces, or total reconstruction if necessary.
14. CUSTOMER-SUPPLIED MATERIAL (FABRICATION WITH CUSTOMER'S OWN GOLD)
When the customer provides their own gold for fabrication, they accept the following:
• Natural loss may occur during the filing, polishing, and finishing process.
• Karat quality may vary due to prior soldering, metal contamination, or unknown alloys.
• If the delivered metal does not reach the weight necessary to fabricate the requested piece, the customer must pay for the additional required material.
• EL ORFEBRE INC. is not responsible for defects, impurities, or inconsistencies resulting from the metal provided by the customer.
• An exact final weight is not guaranteed, as the piece is fabricated according to the required structural and safety parameters.
• EL ORFEBRE INC. will take reasonable precautions in handling the delivered material. However, in the event of partial or total loss of the metal during casting, melting, polishing, or any production stage, EL ORFEBRE INC.'s maximum liability is limited to the market value of the lost metal weight, calculated based on the international spot gold price on the date of the incident.
• EL ORFEBRE INC. shall not be liable for consequential, sentimental, or estimated value damages attributed to the metal provided by the customer.
• Prior to beginning fabrication, EL ORFEBRE INC. will document the weight and condition of the received metal. The customer may request this documentation as a record.
• If the delivered material contains impurities, contamination, or a composition incompatible with the fabrication process, EL ORFEBRE INC. will notify the customer and reserves the right to decline the work without liability.
15. CUSTOMER DATA VERIFICATION & ACCURACY
The customer is responsible for verifying that all submitted information is correct, including:
• Names, initials, and dates
• Styles, sizes, and design details
EL ORFEBRE INC. is not responsible for errors provided by the customer. Any subsequent correction will result in additional charges.
16. TECHNICAL JUDGMENT & CRAFTSMAN RECOMMENDATIONS
EL ORFEBRE INC. reserves the right to make technical decisions necessary to ensure the safety, durability, and functionality of each piece, including:
• Minimum structural thickness
• Height, size, or proportions of letters
• Type of setting
• Amount of metal required
• Reinforcements in delicate areas
These decisions do not constitute changes to the requested design, but rather indispensable technical adjustments for the integrity of the piece.
17. COLOR, SHINE & FINISH VARIATIONS IN PHOTOS OR RENDERS
Visual representations (renders, sketches, photos, or videos) are approximate. Variations may exist due to:
• Lighting conditions
• Automatic camera adjustments
• Screens with different calibrations
• Metal reflections
• Differences between digital finish and actual finish
These variations do not constitute a defect or grounds for a claim.
18. FRAGILITY & CARE OF STONES, SETTINGS & COMPONENTS
Stones, settings, and certain components may loosen or deteriorate with normal use. EL ORFEBRE INC. is not responsible for damage caused by:
• Impacts or falls
• Direct blows
• Lack of maintenance
• Use during physical activities, sports, or while sleeping
Periodic maintenance and repair services may incur additional charges.
19. ESTIMATED PRODUCTION TIME & FORCE MAJEURE
The estimated production time for all custom orders is four (4) to eight (8) calendar weeks, counted from the confirmation of payment or deposit and the customer's design approval.
This timeframe is an operational estimate and does not constitute a delivery guarantee. The customer understands that:
• Delivery times are estimated, not guaranteed.
• Delays may occur due to causes outside EL ORFEBRE INC.'s control, including power outages, severe weather, supplier delays, or force majeure situations.
• During the fabrication process, delays may occur at stages such as wax printing, casting, finishing, or any other production phase.
• A delay in delivery does not constitute valid grounds for a refund or cancellation.
If the customer requires a piece by a specific date, placing the order well in advance is strongly recommended. EL ORFEBRE INC. does not offer rush production services and does not guarantee deadlines.
20. UNCLAIMED ORDERS / PENDING BALANCES
All custom pieces will remain in EL ORFEBRE INC.'s custody until the full balance is paid.
Once the customer is notified that their piece is completed, they will have a period of thirty (30) calendar days to complete the pending payment and coordinate delivery.
If no payment or response is received within that period, the order will be considered abandoned. In such case, EL ORFEBRE INC. reserves the right to retain, dispose of, or sell the piece to recover costs, without any obligation to refund the deposit previously made.
The customer acknowledges and accepts that EL ORFEBRE INC. maintains a lien right over any piece until the full outstanding balance is paid.
21. TECHNICAL MANUFACTURING VARIATIONS
Due to the handcrafted nature of our fabrication process, the exact metal weight, stone size, number of stones, or total carat weight cannot be guaranteed unless expressly specified in writing.
EL ORFEBRE INC. reserves the right to adjust structural dimensions, metal thickness, stone proportions, or technical design aspects when necessary to ensure durability, structural integrity, and aesthetic balance of the piece.
These adjustments are considered part of the normal technical fabrication process and do not constitute defects or grounds for a claim.
22. OFFICIAL PURCHASE REQUIREMENT FOR WARRANTY VALIDITY
The warranty offered by EL ORFEBRE INC. applies exclusively to products acquired through a valid order generated through our official website www.orfebre.com or any channel expressly authorized in writing by the company.
Any transaction conducted outside official channels — including verbal agreements, informal payments, direct transfers, social media messages, or external platforms — will not be covered by warranty.
EL ORFEBRE INC. will not be responsible for terms, conditions, or agreements not formalized within its official order system.
23. PRE-SHIPMENT PRODUCT DOCUMENTATION
EL ORFEBRE INC. reserves the right to document each finished piece through photographs and/or video recordings before shipment.
Such documentation may be used as evidence of the product's condition, finish, and structural integrity at the time it leaves our workshop.
This evidence may be submitted in the event of disputes, claims, or chargebacks.
24. PAYMENT DISPUTES & CHARGEBACKS
All custom and made-to-order pieces are final sale.
By completing a purchase, the customer acknowledges that deposits and payments related to custom projects constitute non-refundable service payments associated with design, production planning, and fabrication preparation.
Filing an unfounded payment dispute or chargeback may constitute a breach of these Terms of Service.
EL ORFEBRE INC. reserves the right to submit all supporting documentation — including order confirmations, policy acceptance records, design approvals, and production evidence — to financial institutions in response to any dispute.
25. FINANCIAL LIABILITY LIMITATION
To the maximum extent permitted by applicable law, the total liability of EL ORFEBRE INC., its officers, employees, contractors, and affiliates, for any claim related to the purchase, use, possession, or maintenance of any product manufactured or sold by the company, is strictly limited to the total amount paid by the customer for said piece.
Under no circumstances shall EL ORFEBRE INC. be liable for:
• Indirect, incidental, or consequential damages
• Loss of income or revenue
• Loss of sentimental value
• Unauthorized replacement costs
• Expenses or payments made by the customer without the company's written approval
The customer expressly agrees that they may not demand compensation beyond the amount originally paid for the product.
26. GOVERNING LAW, JURISDICTION & DISPUTE RESOLUTION
All transactions with EL ORFEBRE INC., as well as the interpretation, validity, and enforcement of these policies, shall be governed exclusively by the laws of the Commonwealth of Puerto Rico.
In the event of any dispute, claim, or disagreement arising between the customer and EL ORFEBRE INC., both parties agree to the following resolution process before initiating any formal legal action:
• Step 1 — Written Notification: The customer must send a formal notification detailing the dispute to servicio@orfebre.com. EL ORFEBRE INC. will have ten (10) calendar days to acknowledge receipt and provide an initial response.
• Step 2 — Amicable Resolution Period: Once the initial response is received, both parties will have twenty (20) calendar days to attempt to resolve the dispute amicably through written communication.
• Step 3 — Formal Mediation (if applicable): If no agreement is reached within the twenty (20) days, either party may request formal mediation before a certified mediator in Puerto Rico. Mediation costs will be shared equally, unless otherwise agreed.
• Step 4 — Legal Action: Only if the formal mediation process fails or is rejected by either party may legal action be initiated before the appropriate courts of Puerto Rico.
The customer's failure to follow this process does not exempt EL ORFEBRE INC. from responding to legal actions, but may be considered by the court when determining costs and attorney fees.
27. SALES AND USE TAX (IVU) — PUERTO RICO
In accordance with the current tax laws of the Commonwealth of Puerto Rico, all transactions with EL ORFEBRE INC. are subject to the applicable Sales and Use Tax (IVU), which will be automatically calculated and added to the order total at the time of payment.
The applicable IVU rate is 11.5%, composed of 10.5% state tax and 1% municipal tax, as established by current legislation. This tax is a legal obligation and cannot be negotiated or waived by EL ORFEBRE INC.
Prices displayed on www.orfebre.com may not include IVU. The final total, including taxes, will be visible before confirming payment.
28. DOMESTIC & INTERNATIONAL SHIPPING
EL ORFEBRE INC. provides insured shipping to Puerto Rico and the continental United States. In special cases and at the company's discretion, international shipments outside the United States may be arranged.
Shipping Liability:
• EL ORFEBRE INC. is responsible for packaging, insuring, and dispatching the package from our workshop until delivery to the designated carrier.
• Once the package is handed to the carrier and a tracking number is generated, custody and responsibility for the package transfers to the contracted shipping service.
• EL ORFEBRE INC. is not responsible for losses, damages, delays, or any incident occurring during transit under the carrier's custody.
Taxes, Tariffs & Customs:
• For shipments to destinations outside of Puerto Rico, including continental states and foreign countries, the customer is solely responsible for paying any import taxes, tariffs, customs duties, or additional charges imposed by destination authorities.
• EL ORFEBRE INC. does not advance, calculate, or cover these charges. A package held in customs does not constitute valid grounds for a refund or dispute.
• The customer is responsible for researching the applicable customs regulations in their country or state before making a purchase.
Address Correction:
It is the customer's responsibility to provide a correct and complete delivery address. Errors in the address that result in package reshipment or loss are the customer's responsibility and may incur additional charges.
29. GOLD MARKET PRICE ADJUSTMENT
Prices quoted for gold pieces (10K, 14K, or 18K) are based on the international gold market value at the time of the quote. Due to the volatility of precious metal markets, EL ORFEBRE INC. reserves the right to adjust the final price if gold value experiences a significant variation between the quote date and the start of production.
In the event a price adjustment is necessary:
• The customer will be notified in writing with the calculated difference.
• The customer must approve the adjustment before production proceeds.
• If the customer does not approve the adjustment within five (5) calendar days of notification, EL ORFEBRE INC. may cancel the order without penalty.
• The deposit paid may be retained as compensation for 3D design services and order management, as previously agreed.
This clause does not apply to Sterling Silver 925 pieces, whose prices are fixed as quoted.
30. INTELLECTUAL PROPERTY & DESIGN OWNERSHIP
All designs, renders, sketches, CAD models, images, and creative content produced by EL ORFEBRE INC. remain the exclusive intellectual property of the company.
Customers are not authorized to reproduce, manufacture, replicate, or commission third parties to reproduce any design created by EL ORFEBRE INC. without prior written authorization.
Any unauthorized reproduction, duplication, or commercial use of our designs, models, or creative concepts may constitute a violation of intellectual property rights and may give rise to legal action.
Designs produced by EL ORFEBRE INC. are intended exclusively for fabrication within our workshop, unless otherwise agreed in writing.
31. SEVERABILITY
If any provision of these Terms of Service is found invalid, illegal, or unenforceable by a competent court, that provision will be interpreted as closely as possible to the original intent, and the remaining provisions will remain in full force and effect.
The invalidity of one clause does not affect the validity or enforceability of the rest of the document.
32. MODIFICATIONS & EFFECTIVE DATE
EL ORFEBRE INC. reserves the right to update or modify these policies at any time without prior notice.

34. ENTIRE AGREEMENT
These Terms of Service constitute the complete and exclusive agreement between the customer and EL ORFEBRE INC. with respect to the purchase, fabrication, and use of the products offered.
This document supersedes and prevails over any prior communication, representation, promise, or agreement, whether verbal or written, including conversations held via social media, direct messages, messaging applications, website chat, phone calls, or any other informal means of communication.
Only written communications made through the official address servicio@orfebre.com will be considered official and contractually binding.
Any additional terms, conditions, or modifications will only be valid if confirmed in writing from that official address.
35. DIGITAL ACCEPTANCE OF TERMS
By completing a purchase on www.orfebre.com, the customer acknowledges and agrees that they have read, understood, and accepted all Terms of Service, policies, and conditions published on this website.
The customer further agrees that the act of placing an order constitutes a legally binding digital acceptance of these terms, regardless of whether the customer reviewed the document in its entirety.
Failure to read the Terms of Service does not exempt the customer from being legally bound by them.
